Supranational criminal prosecution of sexual violence: The ICC and the practice of the ICTY and the ICTR
Supranational Criminal Prosecution of Sexual Violence: The ICC and the Practice of the ICTY and the ICTR examines the evolution of international legal responses to sexual violence in conflict. The book compares how the International Criminal Court (ICC), the International Criminal Tribunal for the former Yugoslavia (ICTY), and the International Criminal Tribunal for Rwanda (ICTR) have defined, prosecuted, and interpreted sexual violence as crimes under international law. Through analysis of landmark cases, prosecutorial strategies, evidentiary challenges, and jurisprudential developments, the work highlights how these institutions transformed sexual violence from a historically overlooked harm into a prosecutable international crime—encompassing crimes against humanity, war crimes, and genocide. It also identifies persistent gaps, including victim protection, stigma, and limitations in enforcement, while offering recommendations to strengthen future accountability and survivor-centered justice in supranational courts.
