Women, Property and Inheritance: Kenya
Kenyan women face a significant gap between the legal equality guaranteed by the 2010 Constitution and the reality of property and inheritance practices, which are often discriminatory and influenced by patriarchal cultural norms. While laws like the Law of Succession Act aim for equal inheritance, discriminatory practices like biased attitudes, lack of legal awareness, ineffective court systems, and biased interpretation of laws persist, leading to women being denied their full inheritance or property rights during divorce. Despite the various progressive pieces of legislations enacted in the recent past, the Kenyan. society is still predominantly patriarchal, and women are consistently marginalized and discriminated upon at family, community and societal levels.
