The effective functioning of the Court requires a definitive obligation on States to cooperate fully and without delay. This obligation must not be undercut by either internal law or international law or obligations, whether pre-existing or developed subsequent to the ratification of this treaty. To sanction by treaty States' discretion not to cooperate in the investigation and prosecution of the international crimes over which the Court has jurisdiction would undermine the principle of universal jurisdiction over genocide, war crimes, and crimes against humanity..
