The Right To Asylum Between Islamic Shari’ah And International Refugee Law: A Comparative Study
This book examines the concept of the right to asylum through a comparative analysis of Islamic Shari’ah and contemporary international refugee law. It explores the normative foundations of protection in Islamic tradition, including principles such as aman (safe conduct) and the obligation to protect the persecuted, and compares them with the legal framework established by the 1951 Refugee Convention and its 1967 Protocol. The study highlights convergences and divergences in the definition of refugees, the rights and duties of states, and the scope of protection afforded to individuals fleeing persecution. It also discusses the practical challenges faced by Muslim-majority countries in reconciling Shari’ah-based principles with international legal commitments, offering insights into the development of more coherent and humane asylum policies in the contemporary global context.
